[ORDER NO. 3,366]
Acting under the provisions of Section 483 of the Re-
vise Statutes (U. S. C., title 35, sec. 6) and with the
approval of the Secretary of Commerce, Rule 79 of the
Rules of Practice of the Patent Office Is amended by
changing in line 9 four months to six months. This rule
to read as follows :
A design patent may be obtained by any person who
has invented any new, original, and ornamental design
for an article of manufacture, not known or used by others
in this country before his invention thereof, and not
patented or described in any printed publication In this
or any foreign country before his invention thereof.
or more than two years prior to his application, and
not caused to be patented by him In a foreign country
on an application filed more than six months before his
application in this country, and not In public use or on
sale in this country for more than two years prior to
his application, unless the same is proved to have been
abandoned, upon payment of the fees required by law
and other due proceedings had, the same as In cases
of inventions or discoveries.
This amendment is for the purpose of making this rule
conform to Section 4887 R. S. (U. S. C., title 35, sec. 32)
as amended by the act of Congress, approved June 19.

Acting under the provisions of Section 483 of the
Revised Statutes (U. S. C., title 35, see. 6) and with the
approval of the Secretary of Commerce, Rule 27 of the
Rules relating to trade-marks, lines 10 and 11, four
months Is changed to 8lw months. The rule now reads
as follows:
An application for registration of a trade-mark under
the act of February 20, 1905, as amended, filed In this
country by any person who has previously regularly filed
in any foreign country which, by treaty, convention, or
law. affords similar privileges to the citizens of the United
States an application for registration of the same trade-
mark, shall be accorded the same force and effect as
would be accorded to the same application If filed In
this country on the date on which application for regis-
tration of the same trade-mark was first filed in such
foreign country:  Provided, That such application be
filed in this country within six months from the date on
which the application was first filed in such foreign coun-
try.
This amendment Is for the purpose of making this rule
conform to Section 4 of the Trade-Mark Act as amended
by the act of Congress, approved June 20, 1936.

Adverse Decisions in Interference
In interferences involving the Indicated claims of the
following patents final decisions have been rendered that
the respective patentees were not the first Inventors with
respect to the claims listed:
Pat. 1,704,754, H. N. Marvin, Radio apparatus and
method of operating the same, decided July 18, 1936,
claims 23, 29, 30, 31, 32, and 33.
Pat. 1,884,546, P. F. Bouvard and T. D. Beckwith,
Paper making technique, decided August 7, 1936, claims
1 and 9.
Pat. 2,012,038, W. W. Eitel and J. McCullough, Elec-
trode support, decided August 10, 1930, claim 3.
Pat. 2,019,971, R. K. Hopkins, Arc-welding machine,
decided August 13, 1936, claiii 1.
Transfer of Classes
Order No. 3,368, August 18, 1936, directs:
The following transfer, to take effect Tuesday, Septem-
ber 1, 1936, Is hereby ordered :
Clsss 195, Chemistry, Fermentation, from  Division 64
to Division 63.
