It has come to my notice that claims are being Inserted by amendment without being ac-
companied by a statement which clearly points out the patentable novelty and without show-
ing how the new claims avoid the references cited by the Examiner. Rule 68 provides that
In-
* * * amending the applicant must clearly point out all the patentable novelty which
he thinks the case presents in view of the state of the art disclosed by the references
cited or the objections made. He must also show how the amendments avoid such ref-
erences or objections.
Examiners will refuse to allow claims where this rule Is not complied with, In amendments
iled after this date. If new claims are inserted without argument or If reconsideration is re-
quested In view of an interview with the Examiner without stating the substance of the Inter-
view, the claims will not be allowed. The reasons must be of record.
Amendments under Rule 78 also must be accompanied by such written statements.
