Disclaimer,
12,159. (Reissue.)-Samuel F. Patterson, Baltlmc're, Md.
PowER-Loom. Patent dated September 29, 1903.
Disclaimer filed March 31, 1919, by the assignee,
Rosemary Manufacturing Co.
Enters its disclaimer as follows:
(a) It disclaims the broadening statement introduced
into the reissued Letters Patent No. 12,159, and appearing
in lines 14 to 37, inclusive, page 4 o- said patent, which
reads:
In the foregoing description I have set forth, and I
have illustrated in the drawings. one form of mechanism
for replenishing the supply of weft thread or yarn, this
involving the displacement of aii empty bobbin, spindle,
or cop from, and the introduction of a filled one into, the
shuttle, and such apparatus I deem the most desirable to
use in practice. My invention, however, includes the
automatic replenishing or renewal of the weft-thread
supply by any known form of mechanism when combined
with the other features herein set forth. Thus, for in-
stance, it comprehei.ds automatic devices for ejecting a
shuttle the weft-thread of which has become broken or
exhausted and replacing the same by a shuttle containing
a filled cop, bob in, or spindle, or supplied with weft-
thread or yarn. The term 'weft-carrier' is, therefore,
used in a somewhat comprehensive sense in some of the
claims and includes shuttles supplied with weft-threads,

as well as bobbins, cops, or spindles, apart from the
shuttles and similarly supplied.
(b) As to claim 1, it disclaims any combination of the
elements therein recitedhewcept when the weaving mecha-
nism recited in such claim comprises a lower or picker
shaft and a crank shaft geared together, both of said
shafts being provided with cranks; and except when the
intermediate connections between the several mechanisms
recited in said claim include rods or pitmen connecting
cranks of the respective shafts with the jacquard mecha-
nism and the lay or lathe of the loom, respectively; and
except when in consequence of breakage or failure of the
weft-thread, the weft fork brings into action parts which
position in the path of a horn or projection carried by
the lay or lathe, a notched block carried by the ejector,
so as to bring about through the movement of the lay
or lathe a movement of the ejector and a consequent fore-
ing of a filled cop, bobbin or spindle from the magazine
or battery into the shuttle of the loom, thereby replenish-
ing the weft and ejecting the spent cop, bobbin or spindle.
(c) As to claim 2, it disclaims any combination of the
elements or groups of elements therein recited except
when the weaving mechanism comprises a picker shaft
and a crank shaft geared together and both provided
with cranks; and except when the connections recited In
said claim comprise rods or pitmen connecting cranks of
the respective shafts with the jacquard mechanism and
the lay or lathe respectively.
(d) As to claim 3, it disclaims any combination of the
elements or groups of elements therein recited except
when the automatic mechanism for supplying filled bob-
bins or spindles to the loom shuttle comprises a maga-
zine or battery for containing filled cops, bobbins or
spindles, an ejector for forcing a filled cop, bobbin or
spidle from such magazine or battery into the shuttle
and thereby ejecting the previously contained cop, bobbin
or spindle from the shuttle, a contact block carried by
the ejector, and a weft fork which determines the posi-
tion of said block and causes it to be brought into the
path of a horn or projection carried by the lay or lathe,
when the weft-thread of a cop, bobbin or spindle in the
shuttle becomes broken or exhausted, and thus brings
1 into operation the ejector.
(e) It disclaims claims 4, 5 and 6 of- said reissued
Letters Patent No. 12,159 because so broadly drawn as to
cover a combination of the recited elements however
brought about.
9 Disclaimer of the broadening statement of the spel-
fication hereinbefore recited and of claims 4, 5 and 6, is
not to be construed, however, as disclaiming, affecting,
abridging or waiving in any manner the full right and
claim to the subjects matter of claims 1, 2 and 3 or any
of them, as the same are limited or defined by the specific
recitals definitely made and applied to these claims as
designated by their respective numbers in this disclaimer.
