MATTER OF:      Lawrence C. Jackson - Relocation Expenses -
                Administrative Intent To Transfer

DIGEST:     Employee who was transferred from
            Lewistown, Montana, to Baker, Oregon,
            claims reimbursement for the costs
            incurred in selling his Lewiscown
            residence. Since project to which
            employee was assigned was ended, and
            since agency was not able to give
            definite r -.. to inquiry concerning
            his next assignment, employee reason-
            ably believed that he would be trans-
            ferred and placed his house on the
            market. Employee may be reimbursed
            for expenses of sale as totality of
            circumstances ind9cate 2 substantial
            compliance with reauirement that
            there be an ad~ministrative intention
            to transfer an employee when real
            estate expenses are incurred.

        Ms. Anita R. Smith, an Authorized Certifying
   Officer, 1 ational Finance Center, U. S. De-arrnt of
   Agriculture, requests our determination as to whether
   Mr. Lawrence C. Jack son, an employee of the Soil
   Conservation Service (SCS), is entitled to reibniorse-
   ment of S2,433.73 for real estate transaction expenses
   that he incurred in the sale of his resi;5ence ar his
   old duty station, befor2 ne received actual. orice of
   his transfer.  For the reasons set forth below, we nold
   that Mr. Jackson is entitled to reimbursement of the
   real estate e... ses.

        ?!r. Jackson was the project engineer in the Big
   Spring Creek W atershed Project at Lewisto.n, 7,.nntana,
   On April 20, 1)77, he attended a meeting at the City-
   County Plann.ng Doard at which a decision wcis made to
   notify the SCS to r:A.ease its funzs because the City-
   County was unable to obtain land acqu-sition monev to
   complete the proTect. On iAoril 21, 1977, the alternate
   contracting officer for the City-County notif=ied the
   State Conservarion tg of :3Ct to release SCS funds for
   the final dam, of the prooject because of lack of local
   funds.
