    DIGEST:

1.   Prior decision holiing that contract award
     violated provisions of 5 U.S.C. 1 3108 (Anti-
     Pinkerton Act) is affirmed upon reconaideration
     since new information daes nwt show decision
     involved any mistake of fact or law warranting
     its reversal or modification.

2.   Request for reconsiderationan ground that
     decision involved error oflAw is denied since
     contention that statute relied upon (5 U.S.C. 5
     3108) in decision is unconstitutional is
     matter for consideration by courts.

     Inter-Con Security Systems, Inc. (Inter-Con), bas requested re-
considsration'cf our decAsion R.L.\ Y6h Company; tfamer Security Service
of Californin  lie., 3-186347, B-185495, October 14, 1976, 76-2 CFD
333, wherein our Office recomended that a contract awarded to Inter-
Con be canceled.  The contract was awarded under request for proposals
(RFP) F04693-75-R-0012, issued by the Department of the Air Force
for security police services to be performed at the Lon Angeles Air
Force Station, Headquarters, Space and Missile Systems Organization
(SAMSO).

     The RPP, a total small business set-aside, requested offerors to
provide uniform-security and law enforcement services, registration
and identifi&ation se4ices, and in estigative &nd administrative
services.  Copies of the solicitation were sent to 42 sources. Seven
proposals ware received in resjnuse to the solicitation on September 15,
1975, the.date set ,for submission of proposals. As a result of a
protest lodged on Oc ober 9,'1975, one of the seven offerors vas deter-
mined to be other thin a small business. After evaluation of proposalu,
Bamser Security Service of California Inc. (Eammer), wae one of the
fiva offerors notified that its proposal was not within the competitive
range.  Pending resolutica of a protest on this issue by Haaner, award
was withheld and SAMSO extended performance under the uontract held
by the incumbent contractor, tha H. L. Yoh Company, Division of Day &
