      Dear Mrs Secretary:

            Further reference is made to latter dated March 5,- 1973, frcm the
       Acting Assistant Secretary of Defense (Comptroller), in which a deci-
       sion is requested as to whether ezisting procedure perti.uin to the
       inscrption unrearried widow en cheks payable to widows under the
       Retired Servicetw'a Family Protection Plan and the Surztvor Benefit
       Plan, Chapter 73, of title 10, United Stateu Code, may be amnded by
       obtaining a one-time certifictia fro= te widow at the tima the
       widowu payments are established Am lieu of present procedure. Depart-
       ment of Dfeuse Military Pay and Allovance Com  ttee Action  o. 469,
       coutaling a discussion of the matter is enclosed with the letter.

           The Comittee Action explains that under the Retired LVerviceman'a
      Fvntly Protection .Plar and the Survivor anefit Plan, a mmber of the
      arzd forces may elect to accept reduced retired or retainer pay in
      order to provide an annuity to certain specified beneficiaries upon his
      death, An annuity payable to or on behalf of the vurviving spouse
      ceases upon the death or regarriage of the survving spouse, with the
      exception that if rerarriage occurs after the surv±vJ4g spoutse attains
      age 60 the mmuity rill ccmtinue undisturbed,

            It iastated that wrder current procedure of the military services,
       the sinoriptionu ot checka payable to widows under the Plans boar the
       qualifyinj legend unremarried widcrw This legend, it io indicated,
       althouh not required by statutory authority, in designed to provide a
       rcviadcr to the payee and second endorsee that the payee i' fntitled to
       the proceeds of the eck only while the unrenarried status continues
       to exist, And, by endorsing the check with such inscription,, the
       payee in effect certifiee to the continued unremarried status,

            It is pointed out in the Comittoe Action that military services
       have been inforund that the Social Security Adniastration and the
       Departmat of H1ealth, Education and Welfaret have disccntinued the
       practice of using the legend unremarried widow on the checks payable
       to widows while they romaid unrerarried, although such inscription had
