  Gentlamen:

       In the letter of September 18, 1973, and prior correspondence,
  you have protested aqainst the rejection of your proposal under
  request for proposals (RFP) Plo. OW003n-73-R-0267(Q), issued on
  January 17, 1973, by the Naval Electronic Systems Conmand (flAVELEX),
  Department of the Navy, for a quantity of YJF-FM (55 channel)
  transceivers. For the reasons net forth below your protest is
  denied.

       As background, contract 1'. 100039-69-C-1501 for production of
  a quantity of AN/E70-34 units, a type of maritime telephonic oquipe
  aent, was. swarded to your firm on July 1, 1968. The Navy advises
  that the AN/Rc-3 was intended to meet the requirements of the
  Inteirnational Tetecommunicationu Union, which allocates commni-
  cation frequencies and wrescribez uses thereof. Subsequent to
  the award of the contract for the A/SRC.34 to your firm, Congress
  enetod Public law 92-63, August 4, 1971, which requires certain
  cateppries of nitor vessels operating on navigable waterways of
  the United States to have a radiotelephone capability on the
  navigational brido and &s requires a listening watch. RAVELEX
  r*yleved the AN/ERC-3. capaLlities and deterained that this
  oquipnent votild met the rcquirements of the statute. Xvwer,
  your contract with Nervy for the AN/ERC-3 was torminated for
  default on August 11, 1972. Thereafter, the Navy felt that it was
  no longer feaible to un the AH/5RC-34 as the mans of meting
  the requirerints of Public Law  e-63, since it was special equip-
  ont rnyring ntensive load tins for design and production.
