Dear Mr. Secretary:

     Thl is in reply to the April 3 and Hay l,. 1973. letters
from the Director of Contracts, Naval Electronics Systems Com-
mand (NESC) regarding the protest of Technology for Communica-
tions International (TCI) agalnst award of a contract under
Invitation for Bids (IFB) N00039-73-B-0254; Step 11, issued by
HESC.

     Request for Propoiial (JtMR) U00039-73-R-0254(Q) Step I,
calting for unpriced technical proposals for h; gh take-off
angle antennas and ancillary itaim, was issued on December I,
1972. Proposals wore received from TCl and from Granger
Associates.   After holding discustions with both offerors, the
Navy determined that the proposals svbmitted by both firms as
supplemented were acccptablef On February 23, 1973, the second
step iFB was issued, calling for prices on the proposals deeind
acceptable.   TC1 bid $173,297.90, while.Grahget bid $156,899.85,
ed after evaluating transportation cots the Navy determined
that Granser's bid was the lowest.   Award of a-contract to Granger
has been delayed pending resolAtion of thm protest.

    TCI argues that the Grager proposal tcwiates trom the
'specification requirements and therefore its second step bid is
nonresponslve. Alternativaly, it is argued that Lhe Step I
specifications should have been revised by an amendment to the
IF? so ims to Give TCl an opportumity to suLait a proposal on an
equal basis. TCl also claims that the Granger bid was nonrespon-
sve because it did not contain required shippi'g information.
TCI hat abandoned its previously expressee asserr ions that the
Granger bid should be 'rejected because it did not indicate the
quantity of silver to be used in performance of thi contract and
because the bid was signed by someone without authority to execute
bids for Granger, and therefore we will not consider those claims.
