                    CAPITAL PUNISHMENT CONFERENCE

                          Columbia University

                          October  7, 1972






          J. Himmelstein outlined the purpose of the meeting

which was to pool the talent, resources, and ideas of this group

of academicians to help in the next stage of the fight to abolish

capital punishment.  Further research by those present and their

associates can give Furman the kind of intellectual, historical,

and sociological foundation that will prevent the Furman decision

from being undercut judicially or legislatively.  There are many

different premises underlying Furman that would benefit by continued

support -- factually and intellectually.  Research is also appropriate

because we are now in a unique situation that is amenable to socio-

logical research -- virtually total abolition.

          The majority opinions clearly eliminate capital punishment

imposed pursuant to discretionary statutes, and research can be

directed to the premises underlying  discretionary capital punishment.

The research also needs'to be directed, however, at  future problems

that will be confronted with possible mandatory capital punishment

schemes.

          T. Amsterdam expressed hope  that our practical purposes

coincide with the philosophical and abstract  interests that members

of this group probably have.   He  pointed out  the time pressures

that we are operating under  (that within a year or two the Supreme

Court could have various challenges to Furman before  it) and the
