                 TORS ON PUBLIC WORKS

Mr. WALSH, from the Committee on Education and Labor, submitted
                          the following

                PRELIMINARY REPORT

                [Pursuant to S. Res. 228 (73d Cong.)]

  The Committee on Education and Labor, authorized by Senate
Resolution 228 of the Seventy-third Congress, second session, to in-
vestigate the relationship between employees and contractors on
public works, submit the accompanying preliminary statement and
report:
  First, the more serious form of abuses indicated by complaints
coming to the attention of the committee is presented by the so-called
kick-back practice. This includes underpayment, short-
change , and other devices employed by contractors to pay their
workers less than the prevailing wage as prescribed by the Bacon-
Davis law and the Public Works Administration regulations.
  To date some 471 complaints from workmen have been acted upon
by the committee staff. Of these, 50 cases were presented before the
committee in public hearings and the testimony of about 100 witnesses
was received. This testimony has been printed in parts I and 11 of
the hearings under authority of Senate Resolution 228.
  Investigation was required in 271 cases. Of these, 48 have been
recommended for further consideration by the committee. The re-
mamning are either still under investigation, have been settled satis-
factory to the complainants, or referred to administrative depart-
ments of the Government for appropriate action.
  Through the efforts of the committee several thousands of dollars
in past-due wages, representing in some cases straight kick-backs
or underpayments, have been collected from contractors for workmen,
and negotiations are at present being conducted which will lead it
is believed, to the collection of additional large sums of money in due
wages at prevailing rates for workmen heretofore underpaid.
