Dear Mr. Nuvamsa:

We  have received the results of the election held on September 30, 1993,
by  the qualified voters of the White Mountain Apache Tribe. The election
was  called  in  accordance with   an order issued on June 15, 1993, by the
Deputy   Commissioner   of   Indian Affairs    (Deputy Conrnissioner), which
permitted  the  qualified voters of the White Mountain Apache Tribe to vote
on the adoption or rejection of the proposed revised constitution.

We  have also   received  several letters contesting    the results of that
election.   After careful consideration, we found nothing that would justify
a recount of the ballots or the holding of a new election which are the
only remedies available under Title 25 of the Code of Federal Regulations,
Part 81.

As  evidenced  by  the conpleted   Certificate of Results of Election, tb
Constitution of the White Mountain Apache Tribe of the Fort Apache India:
Reservation, Arizona, was duly adopted on September 30, 1993, by a vote -
827 for and    531 against   in an election in which at least thirty peroer'.
(30%) of the    2,450 members registered and entitled to vote cast t
ballots.

The  Election Board did not execute the proper certificate of results      f
election which was submitted with the Deputy Commrissioner's authorizat : :
letter of July 15, 1993, (See the penultimate paragraph on page 2). Plei 0
have  the election board    execute the enclosed    certificate, attach
original to   the original of the constitution, and provide this office w'
copies suitable for reproduction.
