Dear Mr. Kozlowski:

On February 13, 1969 this office granted approval of the Revised
Constiuttion of the Jicarilla Apache Tribe with the exception
of the second sentence of Section 2 of Article III; further, a
condition was placed on the approval of Sections 1 and 2 of
Article III that no action would be taken by the tribe under
those sections respecting the enrollment of illegitimate
children of tribal members pending a decision on the legality
of those sections by the Solicitor of this Department.

We now have a decision on the questions involved in this matter.
A copy of the Solicitor's memorandum to this office is enclosed
for your information.

In accordance with the advice from the Solicitor, you are hereby
informed that the second sentence of Section 2 of Article III,
from which approval was withheld, is now disapproved; further,
you are advised that the phrase in legal wedlock as employed
in Section 1, subsection (b) of Article III is void as being
repugnant to the equal protection provision of Section 202 (8)
of the Act of April 11, 1968, 82 Stat. 77.
