Mr. INOUYE, from the Select Committee on Indian Affairs,
submitted the following
REPORT

The Select Committee-on Indian Affairs to which was referred
the bill (S. 1607) providing for the settlement of the water rights
claims of the Northern Cheyenne Tribe, having considered the
same, reports favorably thereon with an amendment and recom-
mends that the bill as amended do pass.
PURPOSE
S. 1607 would provide for the settlement of all claims to Federal
reserved water rights of the Northern Cheyenne Tribe and its
members and allottees, and of the United. States on their behalf. It
would do so by ratifying a water rights compact entered into by the
Tribe and the State of Montana; authorizing the Secretary of the
Interior to enter into a. cooperative agreement with the State for
repair and enlargement of Tongue River Dam to provide 20,000
acrefeet of new water for the Tribe; providing for enhancement of
fish and wildlife habitat; authorizing modifications to the purposes
and operation of the Big Horn Reservoir; and authorizing the Sec-
retary to act as necessary to implement the compact and the legis-
lation.
BACKGROUND
The Northern Cheyenne Reservation was created by Executive
Orders in 1884 and 1900. It encompasses 587,914 acres in a rugged,
partially mountainous area in Big Horn and Rosebud Counties in
southeastern Montana. The Tongue River, which arises in Wyo-
