ACT
SEPTEMBER 29, 1992.-Committed to the Committee of the Whole House on the State
of the Union and ordered to be printed
Mr. MILLER of California, from the Committee on Interior and
Insular Affairs, submitted the following
REPORT
together with
ADDITIONAL VIEWS
[To accompany H.R. 5122]
The Committee on Interior and Insular Affairs, to whom was re-
ferred the bill (H.R. 5122) relating to the settlement df the water
rights claims of the Jicarilla Apache Tribe, having considered the
same, report favorably thereon with amendments and recommend
that the bill as amended do pass.
The amendments (stated in terms of the page and line numbers
of the introduced bill) are as follows:
Page 6, strike line 5 and all that follows through line 13 on page
7, and insert the following:
(a) AUTHORITY OF TRIBE.-When water made available
under the Settlement Contract approved by section 5 of
this Act is not being used by the Tribe, the Tribe may sub-
contract with third parties, subject to the approval of the
Secretary in accordance with this section, to supply water
for beneficial use outside of the reservation, subject to and
not inconsistent with the same requirements and condi-
tions of State law, any applicable Federal law, interstate
compact, and international law as apply to the exercise of
water rights held by non-Federal, non-Indian entities.
Nothing in this Act shall be construed to establish, ad-
