SOUTHERN PLAINS REGIONAL DIRECTOR, BUREAU OF INDIAN AFFAIRS, Appellee. ) ) ) ) ) ) ) ) ) Order Dismissing Appeal Docket No. IBIA 19-074 October 29, 2019 The Delaware Nation (Appellant) appealed to the Board of Indian Appeals (Board) from a May 13, 2019, decision (Decision) of the Southern Plains Regional Director, Bureau of Indian Affairs (BIA), to refund to Marathon Oil Company (Marathon) advance bonus deposits related to 42 unsuccessful bids for oil and gas leases, and to refund to Marathon 75% of bonus deposits related to 29 unapproved leases after Marathon informed BIA that it was unable to obtain the required mineral owner consent and requested that BIA stop processing the leases.' On October 25, 2019, the Board received from counsel for Appellant a filing captioned Dismissal of Appeal, which the Board construes as a motion to dismiss Appellant's appeal.2 'The appeal had been consolidated with another appeal from the Decision filed by the Caddo Nation, Docket No. IBIA 19-075. The Board severed and dismissed that appeal. Caddo Nation v. Southern Plains Regional Director, 66 IBIA 339 (2019). 2 On October 15, 2019, the Board received from Marathon a motion to dismiss Marathon as a party and to order BIA to disburse the refunds due to Marathon.
