                         CONSIT-1OION OF TE UPPER SIOUX COMMUNIrY

              1.    We, the mbers of the Upper Sioux Com mity, in order to form a beter ribal
                    3ov-n       secure the rights and powm of a sovercip Indian nafon, prsetsv
                    our miure and tri   idetity, promote the oci aUd economic wcre of our
                    pople, and safead Wividual rits hereby amend the Revisions of Provigions
                    for Governing the Upper Sioux Community and rename mich docmments the
                    CONS1T=UION OF THE UPPER SIOUX COMMUNITY.

              2.    The   jisdiction  of this govmnt h       amd. to the Upper Sioux
                    Reservation and any x-Mempt TrAian lands within a fifteen (15) mile radius and
                    amy fAws land ac  ed by or for the Community.

              3.    The membership of the Upper Sioux Community shall consist of one of the
                    following:

        ____        A.    All persons of Dakota ndian blood listed on Attach n 'A to the Upper
                           Sioux Community Membership Ordinance adopted by the Board of
                           Trustees September 29, 1995,  provided  said persons maintains
                           residency within a fifteen (15) mile radius of the Upper Sioux Community
                           as defiad by Comui law.

       Snames appear on Attachment A' to the Upper Sioux Community
                          M ebership Ordinance adopted by the Board of Trustees Septmbe 29,
                          1995, provided said lineal descendent establishes and maintains residency
     l .                  within a fiteen (15) mile radius of the Upper Sioux Community for two
                          (2) consective years as defined by Comnity law.
                    C.    All lina descatidants of the original 1938 land assignment holders and/or

  Iz                      recognized descendants of the original 1938 Family of the Pejuhutazizi
                          Village Area (the up prest prior to the ebishient of the Upper
                          Sioux Community Reservadon), provided said descendent (1) possesses
X    -                    one quarter (1/4) degree Mdewlton, Siseon, Wahpeton, or Yahkton
                          Sioux Dakota blood; (2) is identified with the Upper Sioux Coummity by
                          participation in social and service programs sponsored by the Upper Sioux
                          Community; (3) has esabished and maintained residency within a fifteen
                          (15) mile radius of the Upper Sioux Community for two (2) consective
                          yurs as defned by Cormmity lw; an (4) complies with the membership
                          applicati.n procedm established by Comznkiy law.
              4.    The gover mg body of the Upper Sioux Community sh&al be the Board of
                    Thirees and shall consist offi (5) members.
