                                CONSTITUTION
                                    OF THE
                       NATIVE VILLAGE OF AFOGNAK


                                   PREAMBLE

We are Native Americans who are one people with a common Alutiiq and Alaska Native
heritage and cultural association with the Village of Afognak, a federally recognized Tribe,
which we now call the Native Village of Afognak. The Native Village of Afognak is
organized under this Constitution and according to the Indian Reorganization Act of June
18, 1934 (48 Stat. 984, as amended), so that its Tribal members shall have a perpetual source
of land use, shared cultural wealth and social well being.

                               ARTICLE I. NAME

This is the Constitution of the people and the government of the Native Village of Afognak.

                 ARTICLE II. TERRITORY AND JURISDICTION

SECTION 1. TERRITORY. The Tribe's territory includes all lands and waters and interest
in lands and waters within the Tribe's traditional use area, including such Indian country as
may now or hereafter exist within that territory. As soon as practicable after the adoption of
this Constitution, the Tribe shall prepare an official map of its territory.

SECTION 2. JURISDICTION. The Native Village of Afognak shall have jurisdiction to
the fullest extent possible over all lands, waters and people within its territory and members
wherever located to the extent such jurisdiction does not violate federal or Native Village of
Afognak Tribal law.

                          ARTICLE III. MEMBERSHIP

SECTION 1. BASE MEMBERSHIP. Any person of Alaska Native descent whose name
appeared on the Department of the Interior roll for Natives of Afognak, Inc. under the
Alaska Native Claims Settlement Act shall be considered to have been enrolled as a base
member in the Native Village of Afognak. Any living base enrollee may request in writing
not to be so enrolled.

SECTION 2. QUALIFICATIONS FOR MEMBERSHIP. Any blood descendent or
adoptee of Native descent of a base enrollee of the Native Village of Afognak and their
descendants by blood or adoption may, upon application, be enrolled as a member of the
Native Village of Afognak. Upon application, persons of Native descent with historic or
ancestral ties to the Village of Afognak may be enrolled on such terms as the Council in its
discretion may provide by ordinance.

SECTION 3. DUAL ENROLLMENT. A member of the Native Village of Afognak may
be a member of another tribe, but shall not be entitled to dual benefits from the Native
Village of Afognak and any other Tribe.
