                       CONSTITUTION OF THE NATIVE VILLAGE                       RECEIVED
                                       OF KIVALINA
                                                                                   AUG - 5 2013
                                        PREAMBLE

We the people of the Native Village of Kivalina, in order to sustain and perfect our historic form of
tribal government, do proclaim and establish this Constitution for the Native Village of Kivalina.
The Tribal government shall be dedicated to the conservation and careful development of our tribal
lands and other resources, to promote the economic well being of all tribal members, to provide
educational opportunities for our posterity and ourselves, and to promote the social and cultural well
being of our people. This Constitution supersedes the Constitution and By-laws enacted February 7,
1940.

                                    ARTICLE I - NAME


Tis organization shall be called the Native Village of Kivalina(  or Tribe).


                                ARTICLE II- TERRITORY

Section 1. Territory. The territorial jurisdiction of the Tribe shall extend to all lands and waters
constituting the Indian country of the Tribe as defined by federal and tribal law. To the extent not
inconsistent with federal law, such land and waters shall include. but are not limited to all lands and
waters customarily and traditionally governed by the people of the Tribe, including lands withdrawn
for selection by the Tribe under the Alaska Native Claims Settlement Act (43 U.S.C. 1601 et. seq.)
and all fee lands and allotments within the traditional lands of the Tribe, regardless of the issuance of
any patent or unrestricted fee title to any such lands.

Section 2. Jisdiction. The Tribe shall have jurisdiction over all tribal members and over all
persons. subjects, property and all activities occurring within its territory as defined by this Article.
Nothing in this Article shall be construed to limit the ability of the Tribe to exercise its jurisdiction,
based upon its inherent sovereignty as an Idian tribe.


                              ARTICLE III- MEMBERSHIP

Section 1. Membership Requirements. The membership of the Native Village of Kivalina shall
consist of:

   A. All persons who are qualified for and were accepted into membership in the Native Village
          of Kivalina as established by the official Village membership roll as of the date of
          enactment of this Constitution.

   B. All children of members, who are members of the Village as established by the official
          Village membership roll as of the date of enactment of this Constitution.

   C. All legally adopted children adopted by members of the Village. For purposes of this
          Constitution legally adopted refers only to those children legally adopted under tribal,
          state or federal law.
