APPROVING THE FORT HALL INDIAN WATER RIGHTS
SETTLEMENT, AND FOR OTHER PURPOSES
OCrOBER 10, 1990.--Committed to the Committee of the Whole House on the State of
the Union and ordered to be printed
Mr. UDAIL, from the Committee on Interior and Insular
Affairs, submitted the following
REPORT
[To accompany H.R. 5308]
[Including cost estimate of the Congressional Budget Office]
The Committee on Interior and Insular Affairs, to whom was re-
ferred the bill (H.R. 5308) to approve the Fort Hall Indian Water
Rights Settlement, and for other purposes, having considered the
same, report favorably thereon with amendments and recommend
that the bill as amended do pass.
The amendments are as follows:
Page 8, line 13, strike $2,000,000 each year for the 5 fiscal
years and insert $4,000,000 in the first fiscal year, $3,000,000 in
the second fiscal year, and $3,000,000 in the third fiscal year.
Page 8, line 25, strike $2,000,000 to be paid in the first fiscal
year following the effective date of this Act and an additional
$5,000,000 payable in not less that equal annual installments in not
more than a 20-year period, and insert $3,000,000 in the first
fiscal year, $2,000,000 in the second fiscal year, and $2,000,000 in
the third fiscal year.
Page 10, line 25, strike any and insert all.
Page 11, line 13, at the end of the subsection insert In the event
funds are not paid as set forth in Section 7, the Tribes are author-
ized to bring an action in the United States Claims Court for such
funds plus applicable interest. The United States hereby waives
any defense of sovereign immunity to such action..
PURPOSE
The purpose of H.R. 5308, by Mr. Stallings, Mr. Campbell and
Mr. Craig, is to ratify and to contribute to the implementation of
