§ 11. Indian Lands
Cal.2020. Subsec. (a) quot. in sup. (quoting § 15(a) of T.D. No. 2, 2018). Casino owner filed a petition
for a writ of mandate and a complaint for injunctive relief after the Governor of California concurred in
the Interior Secretary's decision under the Indian Gaming Regulatory Act to permit the Estom Yumeka
Maidu Tribe of the Enterprise Rancheria to build a new casino approximately 20 miles away from
petitioner's casino. The trial court sustained the Governor's demurrer and dismissed the complaint, and
the court of appeals affirmed. This court affirmed, holding that California law permitted the Governor's
concurrence in the Interior Secretary's determination to allow casino-style gaming on the land even
though the Interior Secretary took the land into trust for the Tribe after the effective date of the Act. The
court cited the definition of Indian lands set forth in Restatement of the Law, The Law of American
Indians, in rejecting petitioner's argument that casinos could only be built on land that had been taken
into trust for a tribe before the Act's effective date. United Auburn Indian Community of Auburn
