the type ofprovision and the law applicable to the interpretation of the clause, the breach of a
warnanty may void or suspend a policy altogether Alternatively in certain juisdictions or in
certain cases, the breach may void the policy only if the breach is causally elated to the loss or
the breach increases the nsk In other situations, the provision may be unenforceable under state
statute or under state law rules of contactual interpretation. This Article provides an overvew
of the treatment of a breach of wananty by vadous courts, beginng with an overview of
various cowts' treatment ofparticular clauses and concluding with a discussion ofa recent case
example regarding a brach ofan express seaworthiness waranty in a protection and indemnity
(P&I)polcy
