I. INTRODUCTION
Parents usually take part in the raising of their children more than
anyone else. They sacrifice and work hard so that, hopefully, their
children won't have to. They teach their children the lessons they
have learned in their own lives. One day, their children have children
of their own, and the cycle continues. A new parent often turns to his
own parents, the grandparents of his children, for help and guidance
in childrearing. After all, this is something the new parent has never
done before, but his parents have-they raised him. Raising a child
is one of the many life experiences that parents teach their children.
It comes as no surprise that the grandparents will be very much
involved in the raising of their grandchildren-their commitment to
their grandchildren is part of their commitment to their own children.
The grandparents generally become emotionally attached to their
grandchildren, who, in turn, become emotionally attached to them.
This emotional attachment will, undoubtedly, continue if the grand-
parents' child is to pass away. But what should happen if a parent
wants to break this emotional attachment between the children and
their grandparents?
Under common law, grandparents did not possess a third-party
right to visitation, and, thus, their petitions for visitation with their
grandchildren were dismissed for lack of standing.2 Through the
1950s, the American family consisted of primarily the father,
mother, and children.' However, the traditional family structure has
