L 'auteur argumente que la dicision de la Comission
de restructuration des services de sante de
transformer  IHpital Montfort en   clinique
ambulatoires constitue de discrimination qui viole
l'article 15 de la Charte canadienne des droits et
libert6s. Il dimontre que la dicision crde une
distinction discriminatoire puisque 'elle retire de la
communautifrancophone de lOntario I'accas aux
services midicaux et ai une dducation mddicale en
frangais, un ddsavantage qu 'ellen 'impose pas aux
anglophones. Il explique aussi que la communautj
francophone constitue un groupe analogue 6 ceux
inumires b l'article 15 puisqu'elle forme une
minoritd discrete, isolie et vulngrable qui a djt
victime de ddsavantages historiques. Finalement, il
explique que le recours approprij pour rectifier
1 'acte discriminatoire du gouvernement Ontarien est
le maintien d'un h6pitalfrancophone autonome.

The Author argues that the decision of the Health
Care Restructuring Commission to transform the
Montfort hospital into a walk-in clinic constitutes
discrimination and violates Article 15 of the
Canadian Charter of Rights and Freedoms. The
author shows that the decision    creates a
discriminatory distinction since it denies access to
healthcare services and medical education to the
Francophone community, a disadvantage which it
does not impose onAnglophones. He also explains
that the Francophone community constitutes a
group analogous to those enumerated in Article 15
as they form a discrete, isolated and vulnerable
minority that has been the victim of historical
disadvantages. Finally, the author explains that the
proper course of action needed to rectify the
Government of Ontario's discriminatory action is to
ensure the maintenance of an     autonomous
Francophone hospital.
