I. INTRODUCTION
Ask any law student to place society's laws on a reality continuum.'
At one end he would probably place those laws which are functionally
realistic, i.e., laws which change with ease and rapidity as the external
situation changes. Here he would probably locate business and com-
mercial regulations or emergency measures dealing with traffic or pub-
lic safety.
At the other end, our student would most likely place laws which
reflect literal morality. These laws typically do not reflect reality.
They are slow to change and only do so after much legislative
agonizing. Here we would probably find our student has lumped laws
dealing with sexual behavior, family relations, and any behavior in-
volving social mores and taboos.
But after January 1, 1970, where would he place California's divorce
laws? On that date the State's most sweeping change in divorce legis-
lation in nearly a century will go into effect.'

CAL. CIVIL CODE §§82-150.4, deal generally with California divorce law. Although
a number of sections have been amended since first enactment, most sections were
enacted between 1872-1874.
